THESE TERMS ARE SUBJECT TO CHANGE WITHOUT PRIOR NOTICE. WE WILL POST UPDATES AND CHANGES ON THIS PAGE. BY PURCHASING A PRODUCT THROUGH THE SITE, YOU AGREE TO BE BOUND BY AND ACCEPT THE TERMS OF SALE IN EFFECT AT THE TIME OF SUCH ORDER. IF YOU DO NOT ACCEPT THE TERMS OF SALE STATED HERE, DO NOT USE THE ONLINE STORE.

ACCOUNT

The account you create on our website is your sole responsibility. Therefore, you are responsible for the confidentiality of your password and further agree to accept any responsibility for all purchases made under that account. We are not responsible for any lost or stolen passwords. Therefore, we expect you to inform us when you no longer have intentions of using the account, so that we may remove it from our database.

ELIGIBILITY TO PURCHASE

In order to place orders with us, you must meet our conditions in order to be eligible:

For B2C (Business-to-Consumer) Customers:
a) Be aged 18 years of age or older
b) Must possess a valid credit card (Visa or MasterCard) for payment
c) Must provide accurate and legitimate information (real name, email, address, billing information, phone number and other information indicated)
d) In placing an order, you authorize Universal Electric Motors to process a charge to the credit card account in the amount you purchased
e) Must agree that the goods purchased hereunder will suitably meet the requirements of their intended use
f) Must agree to our Terms of Sale

FOR B2B (Business-to-Business) Customers:
a) Must use a purchaser aged 18 years of age or older
b) Must be responsible for management of access & passwords with users in your company
c) Must possess a valid credit card (Visa or MasterCard) for payment
d) Must provide accurate and legitimate information (real name, email, address, billing information, phone number and other information indicated)
e) In placing an order, you authorize Universal Electric Motors to process a charge to the credit card account in the amount you purchased
f) Must agree that the goods purchased hereunder will suitably meet the requirements of their intended use
g) Must agree to our Terms of Sale

PAYMENT TYPES

For B2B and B2C Customers, we accept Visa and MasterCard only. If you pay with a credit card, you agree that you have authorization to use the credit card and authorize us to charge your order to that card.

PRICING & AVAILABILITY

All prices (and applicable shipping and tax) for products are shown in U.S. dollars. By placing an order, you agree that we reserve the right to implement quantity limits, discontinue products and reject an order if we feel the need to. We reserve the right to change any pricing and product availability shown without notice. Orders for export outside of Canada will NOT be subject to Canadian sales tax, but may be subject to local sales tax and/or any duties or brokerage fees that may be applicable. It is solely the customer’s responsibility to ensure proper payment of these fees/charges.

ORDER ACCEPTANCE

There is no guarantee that the orders you place will be accepted. We hold the right to refuse and withdraw any orders at our own discretion. Therefore, we recommend that you provide us with full information so that there are no problems in accepting the order. We may ask you to provide us with further information when placing an order. This is to ensure your order is without conflict.

BACK ORDERS

Universal Electric Motors cannot guarantee that all products offered online are in stock at all times. Certain products may be placed on back order until replenished. We will only ship your order when all products are in-stock. Once you receive the order confirmation e-mail, showing products on back order, you can click on the item(s) and select “Notify me when this product is available”. This will automatically generate an e-mail to notify you when the product arrives at our warehouse.

Universal Electric Motors will ship your order complete only; this is to ensure the lowest shipping costs.

SHIPPING

FedEx® is used as our exclusive shipping courier. All orders are shipped FOB shipping point. Shipping charges will be the buyer’s responsibility, unless Universal Electric Motors states otherwise. We reserve the right to change shipping charges without notice. Once the order is shipped, the title is then transferred to the purchaser, we are not responsible for any delays or problems the products encounter in transit.

RETURN POLICY

If for whatever reason, a motor needs to be returned, the freight must be prepaid. You must also request an RMA number before the motors are returned. The return must be requested within fourteen (14) days of the original shipment date. New motors in original, clean and unmarked packaging will have a 25% restocking fee applied to the credit (cost of the motor only).

If your product is defective and would like it to be covered by warranty, please refer to our Warranty Claim Form.

FREIGHT DAMAGE POLICY

It is the sole responsibility of the customer to inspect all packages for damages prior to signing the shipping receipt. Universal Electric Motors will NOT be responsible for filing any damage claims. The purchaser must contact the freight company and file the damage claim themselves. Please note, that if you inspect the product before the truck leaves, you can avoid filing a damage claim if you refuse to take the product.

Torn or dented boxes do not necessarily mean that the product itself is damaged, please open the box and inspect the product thoroughly.

ERRORS & MISTAKES

We do not express or imply that products adjust exactly to the descriptions, prices and/or photos we supply. We have made all rea­sonable efforts to accurately determine a suitable product and its dimensions. We do not warrant that all product information on this site is accurate. We reserve the right to correct errors and revise your order accordingly.

GOVERNING LAW & JURISDICTION

The use of our website and content shall be governed by the laws of the Province of Ontario and the laws of Canada. These terms of sale and all online sales shall also be governed and construed with the laws of Ontario. This includes the dismissal of conflict against the law provisions. The parties agree that any dispute deriving under or in association with these Terms shall be submitted to the Courts having jurisdiction in the Province of Ontario for adjudication.

LIMITATION OF LIABILITY

All content or services available or offered on our website are provided to you on an “as is” basis, without representations, conditions or warranties of any kind. You acknowledge and agree that any reliance by you on any information available on this website shall be at your own risk.

In no event shall Universal Electric Motors be liable for any consequential, incidental, or any other damages. Universal Electric Motors is also no way liable for any loss of profits the company may face.

We make no promises that our website or servers are free of viruses or other harmful components. We recommend all users who use this site to ensure they have up-to-date software, including anti-virus, installed.
